Ticket Refund Policy and Terms & Conditions

THIS TICKET IS A REVOCABLE LICENSE

By accepting/using a ticket (in any form) (“Ticket”) for the USA Pickleball Association (“USAP”) event (“Event”) at Barnes Tennis Center (“Venue”), the Ticket holder (“Holder”), on behalf of (a) itself, (b) any minor(s) accompanying Holder, and/or (iii) any others accompanying Holder for whom Holder possesses a ticket to attend the Event with Holder (each of whom Holder represents and warrants have authorized Holder to act on their behalf in accepting these Ticket terms) (collectively with any accompanying minor (“Accompanying Guests”), agrees to the terms herein (“Terms”).

This Ticket is subject to all rules, regulations and policies relating to tickets as established from time to time by USAP, which may be updated at any time. Resale or attempted resale at a higher price than purchased is grounds for seizure or cancellation without refund or other compensation.

IMPORTANT: HOLDER, ON BEHALF OF ITSELF AND ITS ACCOMPANYING GUESTS:

Agrees professional photography, video and/or audio recording equipment are prohibited. Flash photography is also prohibited. Agrees the use of mobile telephones (or other mobile devices) within the Venue is permitted, provided that: They must not inconvenience or interfere with any other person at the Venue. They are used for private person to person use only. They shall not be used to capture, log, record, play, issue, show, transmit or aid in any of the same of any material, information or data, including, but not limited to the description, account, picture, audio, video, reproduction or other information about the Event (“Event Materials”) for any commercial purposes. No Event Materials that are captured by a mobile telephone (or other mobile device) may be published or otherwise made available to any third parties for commercial purposes including, without limitation, publication for commercial gain via social networking sites. They must not be used to capture, supply or transmit Event Materials for the purposes of betting or gambling (or assisting for these purposes).Agrees that USAP is the exclusive owner of all proprietary rights, including, but not limited to copyrights of the Event and Event Materials. Agrees that the Ticket may not be used for advertising, promotions (including contests and sweepstakes) or other commercial purposes without the express written consent of USAP. Breach of the forgoing will automatically terminate the license for which this Ticket is granted. Grants permission to USAP, and/or its affiliates, sponsors, broadcast/media partners and Venue to use, for all purposes, Holder’s name and likeness (including, but not limited to images and voice) taken in connection with the Event or Event activities as described below in any medium (now known or later developed), including, but not limited to electronic, live or recorded video display, photograph, sound/video recording, broadcast and/or other transmission or reproduction, in whole or in part, of the Event or Event Activities without notice or compensation. Agrees the use of obscene and/or profane language, intoxicated or disorderly behavior, interfering with the Event or Event activities as described below (including throwing objects on a court, in the stands or on a performance stage), entry to any unauthorized area is prohibited. Breach of the same is subject to detention, ejection and/or arrest without refund. Agrees not to bring into (or wear at) the Venue any objects or clothing bearing political statements or commercial identification intended for “ambush marketing,” including, without limitation, items or objects given away as part of a promotional or marketing campaign by third parties near the Venue and/or any object or clothing which is offensive or could be deemed to be offensive. Agrees not to offer or distribute (either free or for sale by any person) within the Venue any consumer article or commercial product of any nature. Agrees the possession or use of weapons, fireworks, drones, glass containers, outside alcohol, illegal substances or any item deemed dangerous or disruptive by USAP or Venue security is strictly prohibited and is subject to detention, ejection and/or arrest without refund. Agrees to security searches and/or screening, consents to health-related procedures for attendance and waives all related claims. Agrees nothing in these Terms shall constitute or imply permission to attend a USAP event or enter the Venue for any occasion other than for which the Ticket was purchased.

WARNING: Holder, on its own behalf and on behalf of any Accompany Guests, assumes all risks and danger associated with the Event, any promotions or  activities before, during or after the Event (“Event Activities”) or attendance at the Venue and acknowledges that attendance is voluntary  and agrees that USA Pickleball Association and all related entities and affiliates, together with their respective owners, officers, directors, employees, agents, licensees, sponsors, broadcast/media partners and vendors (collectively, the “Released Parties”) are not responsible for any personal injury (including death), illness, property damage and any and all other hazards, damage or loss arising from or related in any way to the Event and/or Event Activities, the negligence of any of the Released Parties, natural occurrences, any other incidents caused by persons or play of game (including but not limited to, the danger of thrown or paddles, pieces of the same, balls and other objects (including, but not limited to, promotional items). By attending the Event and/or Event Activities, Holder on its own behalf and on behalf of any Accompany Guests is deemed to have given a full release of liability to the Released Parties to the fullest extent permitted by law from any claims which Holder, and/or any Accompanying Guests, has or may have for causes of action arising out of attendance at, observation of and/or participation in the Event and/or Event Activities. If Holder is unable, unwilling or unauthorized to grant such rights, releases and waivers on behalf of an Accompanying Guest, Holder should immediately leave the Venue with each Accompanying Guest.

AN INHERENT RISK OF EXPOSURE TO COVID-19 AND OTHER TRANSMISSIBLE DISEASES EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS TAKEN. HOLDER, ON BEHALF OF ITSELF AND ON BEHALF OF EACH ACCOMPANYING GUEST, AGREES TO ASSUME ALL RISKS ASSOCIATED WITH ANY TRANSMISSIBLE DISEASES AND COMPLY WITH ALL RELATED HEALTH AND SAFETY POLICIES OF THE RELEASED PARTIES.

ANY DISPUTE, CLAIM, OR CAUSE OF ACTION ARISING OUT OF HOLDER’S ATTENDANCE AT THE EVENT AND/OR EVENT ACTIVITIES SHALL BE SETTLED BY MANDATORY, CONFIDENTIAL AND BINDING ARBITRATION HELD IN PHOENIX, ARIZONA, GOVERNED BY JAMS IN ACCORDANCE WITH THE THEN-CURRENT COMMERCIAL RULES OF ARBITRATION. NEITHER HOLDER NOR USAP SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS IN ARBITRATION BY OR AGAINST OTHER INDIVIDUALS OR ENTITIES. ALL PARTIES WAIVE ALL RIGHTS TO TRIAL BY JURY IN ANY ACTION OR PROCEEDING INVOLVING ANY CLAIM.
THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR LOST, STOLEN, DAMAGED OR DUPLICATED TICKETS AND/OR FOR TICKETS OBTAINED FROM SOURCES OTHER THAN DESIGNATED REPRESENTATIVES OF USAP.

NO REFUNDS, EXCHANGES OR CANCELLATIONS. DATE AND TIME OF THE EVENT AND/OR EVENT ACTIVITIES ARE SUBJECT TO CHANGE. PLEASE LOOK TO USAP’S WEBSITE FOR UPDATED INFORMATION.
